Terms of Service

Kimcura is a math learning app for students in Chile, operated by BRAVO CIENCIA Y TECNOLOGÍA SPA (“we”, “us”). These Terms of Service (“the terms”) govern the use of the Kimcura mobile app (Android and iOS) and the kimcura.cl website.

By using the app or the site you accept these terms; if you do not agree with them, do not use the service. If you are under 14, the adult who authorizes your account accepts them on your behalf (see “Age and minors”).

Kimcura offers math exercises, PAES-style practice tests, study articles, videos, missions and streaks, together with optional social features (comments, a shared 3D plaza and practice duels) and an optional subscription called Kimcura Plus.

The service evolves constantly: we may add, change or remove features to improve the app, comply with the law or protect the people who use it. Some features — the social ones in particular — require prior consent and, on accounts of children under 14, the authorization of a responsible adult, so they are not available on every account.

Kimcura is designed for school students, including minors. We do not require you to be an adult to use the app; instead we apply rules based on the age declared on the initial screen:

• Under 14: Chilean law requires the authorization of the mother, father or whoever holds personal care of the child. The account is held pending until that authorization exists, and that adult accepts these terms on the student's behalf. Social features stay disabled until the responsible adult enables them.
• 14 to 17: you may accept these terms and use the service on your own.
• 18 or older: you accept and use the service in your own name.

The details of how age verification and parental authorization work are in the Privacy Policy, which governs that matter.

You do not need an email account to use Kimcura: guest mode lets you use the full app anonymously. If you want, you can later link a Google account to keep your progress when switching devices.

Regarding your account we ask three things:

• Answer the age screen truthfully when you first open the app.
• Take care of access to your device and your account: whatever is done from your account is understood as done by you.
• Do not create accounts to evade a sanction or to pass yourself off as someone else.

Because guest accounts have no email attached, important notices about the service are communicated inside the app itself.

Kimcura is a study space shared with minors and we take conduct seriously. By using the service you agree not to:

• Harass, intimidate, insult or discriminate against other people, or post illegal, sexual, violent or harmful content, if you use the social features.
• Ask for or share other users' contact details, especially those of minors.
• Impersonate another person or pass yourself off as the Kimcura team.
• Cheat: manipulate XP, streaks, hearts, missions, duels or any other mechanic of the service by exploiting bugs or using automated means.
• Circumvent the age screen, moderation sanctions or any technical restriction of the service.
• Scrape content at scale, interfere with the operation of the service, or attempt to access other people's accounts or systems.

If you find a bug or a vulnerability, please report it to contacto@kimcura.cl instead of exploiting it.

If you use the social features you can post comments (up to 500 characters), reactions and likes. That content is visible to other people inside the app.

The content you post remains yours. You grant us a non-exclusive, royalty-free license to host it, display it within the service and moderate it, only to the extent needed to operate Kimcura. We do not use your content commercially outside the service.

Moderation combines an automated filter with human review. We may hide or remove content and apply sanctions — mutes, suspensions or bans — without prior notice when these rules are broken. From the app itself you can report content and block other people.

Two points that are also in the Privacy Policy: moderation records are kept pseudonymized for 24 months after a sanction ends, even if you delete your account, and copies of a comment included in other people's notifications do not disappear when the original comment is deleted.

Kimcura Plus is an optional auto-renewing subscription purchased through Google Play or the App Store. The current price is shown in the store before you confirm the purchase, and the charge renews automatically until you cancel.

Payment is processed entirely by the app store: Kimcura never sees or stores your card details. Cancellation, refunds and any billing dispute are handled with the store's own tools and policies (Google Play or the App Store).

Plus benefits — such as premium practice tests, practice without the hearts limit, exclusive cosmetics and unlimited daily-mission rerolls — may be adjusted over time; relevant changes are announced inside the app.

Deleting your account does not cancel the subscription: you must also cancel it in the store where you purchased it.

XP, streaks, hearts, missions, prizes and avatar cosmetics are virtual items of the service: they have no monetary value, cannot be exchanged for money or transferred to other accounts, and we may adjust or reset them for game-balance reasons or to correct abuse.

Some of these items, such as hearts, are stored only on your device, so they are lost if you uninstall the app or clear its data.

The service's content — exercises, articles, videos, animations, art, 3D models, the Kimcura brand and the software — is owned by us or used under license. We grant you a limited, personal, non-commercial license to use it for educational purposes within the service. That license does not allow reselling the content, redistributing it at scale or presenting it as your own.

Some practice tests are built from PAES tests published by DEMRE; we claim no authorship over that source material.

The processing of your personal data is governed by our Privacy Policy, available at kimcura.cl/privacidad, not by these terms. There you will find the details of what data is collected, under which legal bases, for how long it is kept and which providers it is shared with.

From the app you can download a copy of your data in JSON format, delete your account completely, and turn optional consents on or off (You tab, Privacy section). Kimcura shows no advertising and does not sell your data.

We offer Kimcura “as is”, with the best effort of a small team. We do not guarantee that the service will be available without interruption or free of errors, and we may modify, suspend or discontinue features or the entire service; when a change is significant we will announce it inside the app.

Kimcura is a study-support tool: it does not guarantee scores or results on the PAES or any other exam.

To the extent Chilean law allows, our liability is limited to direct damages that result from our breach of these terms. We are not liable for damages arising from use of the service contrary to these terms, or for failures caused by factors outside our reasonable control.

Nothing in these terms limits the rights Chilean law grants you that cannot be waived, in particular those of Law No. 19.496 on consumer protection and Law No. 21.719 on personal data protection.

On your side: you can stop using Kimcura whenever you want and delete your account directly from the app, in the You tab. Deletion erases your account and your data, with the exceptions detailed in the Privacy Policy: moderation records are kept pseudonymized for 24 months after a sanction ends, and for suspended accounts an irreversible identifier (a hash of the email) is kept to prevent re-registration. Also remember to cancel your Kimcura Plus subscription in the store, because deleting the account does not cancel it.

On our side: we may suspend or terminate accounts that break these terms — the acceptable-use rules in particular — or when the law requires it; sanctions are applied inside the app and may take effect without prior notice. When an account ends, its progress and virtual items are lost; any subscription refunds are handled directly with the store under the store's policies.

We may update these terms when the service or the law changes. The current version is always published on this page together with its effective date, and significant changes are announced inside the app before they take effect. If you keep using the service after that date, you are understood to accept the updated terms.

These terms are governed by the laws of the Republic of Chile, and disputes arising from them are submitted to the competent Chilean courts. If you act as a consumer, you also keep the channels the law gives you, such as SERNAC.
